Employment Law
 

The bond between an employee and an employer is a strong one. When those ties break, contentious litigation often follows. The Allen Law Firm represents employers and employees in numerous employment claims and both individual and class action suits.

 

By bringing our extensive employment and labor law experience to bear on each and every client, we analyze each with a personal touch for the complex issues that are often associated with such a dispute, for civil trial and appellate litigation. We focus on employment practice primarily in the following areas:

 

  • Employment Discrimination: The law protects workers from unlawful discrimination.  Being subjected to an adverse employment action, or treated differently than others in the terms or conditions of employment, because of race or ethnicity, gender or sex, age, disability or health condition, religious beliefs, pregnancy or family responsibilities, or other protected status is illegal.

  • Hostile Work Environment / Harassment: Employees are entitled to be work in an environment free of highly offensive, hostile or abusive working conditions based upon sex, race, or other protected classification.

  • Wage and Hour: Employees are entitled to be paid for the hours and overtime worked. 

  • Family and Medical Leave: Under certain circumstances, employees are entitled to leave for themselves or to care for a sick family member.  Being denied this time off or being fired for taking it could be a violation of the Family and Medical Leave Act

  • Retaliation: In some circumstances, if an employee complains of discrimination and is subjected to an adverse employment action -- such as termination or demotion -- he or she may have a claim of retaliation.

Mediation

 

James M. Allen is an active Rule 31 Mediator.  Mediation is an informal process in which a neutral person conducts discussions amound the disputing parties designed to enable them to reach a mutually acceptable agreement amount themselves on all or part of the issues in dispute.  The "mediator" is a neutral person, trained and skilled at facilitating communications, negotiations and dispute resolution.  Mediation is cheaper, faster and less stressful than litigation.  And mediation puts you in control of the outcome of your case.

Family Law

 

Sometimes marriages falter. If you and your spouse hope to salvage your marriage, we encourage you to seek counselling with a respected marriage counsellor. However, if the marriage is clearly failing, one or both spouses should seek legal counsel.
